The Federal Criminal Justice Process
Following the investigation, you may face an indictment by a grand jury, after which an arrest warrant would be issued. The U.S. Constitution guarantees you the right to due process, which includes several steps including possibly a detention hearing or preliminary hearing, after which you will be arraigned and then either reach a plea bargain or face a trial. Under the Federal Speedy Trial Act, you have the right to a trial within 70 days of your initial appearance, although you may ask for additional time to prepare.
Convictions for federal crimes can result in severe penalties, including lengthy prison sentences, fines, and asset forfeiture. Since the federal criminal justice system operates differently from state criminal justice systems, it’s crucial to have representation with federal criminal law experience to represent you.
