VETERANS ADMINISTRATION APPEALS
Accessing VA benefits is often a crucial factor in allowing our honored veterans the opportunity to build the bright future that they richly deserve. When you apply to the VA for benefits, the regional office will send you a decision known as a ratings decision. Unfortunately, the ratings decision may not always be favorable.
If you feel that you have been unfairly denied benefits, it is very important that you contact an experienced lawyer as soon as possible. The laws regarding military personnel and veterans can differ from civilian laws and you need a law firm that is well-versed in veteran’s administration appeals. The Federal Practice Group is very knowledgeable and accomplished in veterans’ affairs cases and understands the timelines involved as well as what is needed to launch a successful appeal.
STEPS IN THE VETERANS APPEALS PROCESS
The first step in appealing a VA decision is to file a Notice of Disagreement that allows you to request a personal hearing and another review of your case by a decision review officer. An attorney from the firm can tenaciously represent you at your hearing. One of their accomplished military criminal lawyers may be able to assist you in successfully appealing a decision and receiving your full level of available benefits.
Following the hearing, the decision review officer will issue a statement of case, or SOC. A seasoned attorney from the firm will work closely with you to evaluate the SOC pertaining to your case to determine your options. You have the opportunity to present further evidence to your SOC. If your claim is still denied, you have 60 days to appeal to the BVA, Board of Veterans Appeals, where you have the right to another hearing. If the BVA denies your claim, you can still appeal to the United States Court of Appeals for Veterans Claims. The firm is determined to aggressively fight for the rights of our clients throughout the process.
