After a person is arrested or undergoes an investigation, a removal proceeding is scheduled to determine whether he or she will be deported. The immigrant receives a “Notice to Appear” (NTA) from Immigration and Customs Enforcement, part of the federal government’s Department of Homeland Security.
The removal proceeding is presided over by an immigration judge, who hears arguments from both the immigrant’s attorney and the USCIS (US Citizenship and Immigration Services), the government agency seeking deportations. The judge then hands down an order of termination, relief from removal, or a removal.
There are a number of grounds for inadmissibility you may experience on a non-immigrant visa or even green card. Such examples include:
Depending on your situation you may be eligible for defenses to removal like a cancellation of removal, asylum or voluntary departure.
In many cases, an undocumented individual may be arrested for a traffic violation and then taken into Immigration and Customs Enforcement (ICE) custody at a holding facility. If an undocumented relative is taken to a detention center an immigration attorney at The Federal Practice Group may be able to help you acquire a bond for them to be released.
Our deportation defense lawyers can also help you with your Petition for Judicial Review before any of the United States Courts of Appeal and/or Judicial Action in District Court no matter where you live in the United States.
