Eric Montalvo Discusses Bergdahl Case w/ Idaho Mountain Express

In a recent Idaho Mountain Express article by Tony Evans, Attorney Montalvo discussed the recent events in the case of Army Sargent Bowe Bergdahl.
A MATTER OF EVIDENCE
The case against Bergdahl, who faces charges of desertion and misbehavior before the enemy, has been suspended due to a dispute over the sharing of evidence. According to a CNN report, his defense team has had access to just 1% of the classified documents which are related to the case. Recognizing the potential significance of this evidence, Judge Col. Jeffrey Nance ordered the stay of proceedings while an appeals court determines which classified evidence may be shared with the defense.
Per Attorney Montalvo, the military seems to feel that the defense, in requesting this information, is essentially going on “a fishing expedition,” trying to find evidence to bolster their case. He added that “It would seem highly likely that the defense will get access to the information they are seeking if it is relevant, necessary to their case and if they have asked with some specificity.” The stay of proceedings should give Bergdahl’s team more time identify specific information they need.
